CG Shops: Terms of Service

1. Who we are

CG Shops and CG Sites are services of Aspar Software EOOD, entered in the Bulgarian Commercial Register under UIC (ЕИК) 204145835, VAT no. BG204145835. Registered office: 9 Aleko Konstantinov St., 7700 Targovishte, Bulgaria. Email: [email protected]. Supervisory authorities: the Commission for Personal Data Protection (КЗЛД, personal data) and the Communications Regulation Commission (КРС, digital services).

2. The contract

These Terms, the Data Processing Agreement (DPA) and the prices form our contract. The service is for businesses only, not for consumers. You accept by ticking the box when you claim the shop, on the claim page or in the chat on our site, and we agree that the click counts as your signature. We record the version you accepted and when. You can save or print this page, and we send you an earlier version if you ask.

3. What we provide

We build and host your shop at <name>.cgshops.com, in Google Cloud in the EU (Frankfurt, Germany). That includes the storefront and admin, the shop’s emails (up to 100 an hour), AI assistants, nightly backups of the database and files, kept for up to 6 months, and updates, which we schedule. If a change substantially reduces the service, we give you 30 days’ notice, and you may leave with a refund of your prepaid fees.

4. Artificial intelligence

  • Our AI assistant drafts your shop: in the chat at manager.cgshops.com/build, where you sign in with Google or with your email, or, if you prefer, in the CraftGenie Shop Builder app in ChatGPT. It says at the start of the chat that it is an AI, not a person.
  • The chat on our site runs on Google’s Gemini model in Google Cloud Vertex AI, in the EU. In ChatGPT, the chat runs on OpenAI’s service, under your agreement with OpenAI. We then receive the shop details the assistant sends us, and some technical data to limit requests. Details: in our Privacy Policy.
  • AI makes mistakes. Check your shop before you open it, especially prices, VAT and legal details. You are responsible for what your shop publishes.
  • An AI client that you connect to your admin acts with your rights. It needs your confirmation for risky actions, and you can disconnect it at any time. Its provider receives what the client reads, under your own agreement with that provider.
  • We do not use shop data to train AI.

5. Your responsibilities

You are responsible for your shop and your sales, including:

  • consumer, tax and fiscal rules, including receipts and invoices;
  • your legal pages (our templates are not legal advice);
  • your goods and content;
  • your accounts with payment providers and couriers;
  • accessibility rules, if your business is larger than a microenterprise.

Keep your password safe, and use two-factor sign-in. Shoppers pay into your own accounts; we never hold their money. Keep your own exports of orders for as long as accounting law requires, because we are not your archive.

6. Prohibited use

You must not use the service for:

  • illegal goods or content, or goods that need a licence you do not have;
  • counterfeits, or content that infringes other people’s rights;
  • spam, phishing, malware or fraud;
  • overloading, scanning or attacking the service.

7. Illegal content

Anyone can report content they think is illegal, at [email protected]. Say why it is illegal, and give its URL and your name and email.

  • People, not algorithms, handle reports, and do so promptly.
  • If we remove content or restrict your shop, we tell you why and how to challenge the decision. You can reply within 6 months, and we will review it.
  • We do not monitor shops. We act on reports, on authorities’ orders, and on what we notice ourselves.
  • Contact point for authorities and users: [email protected], in Bulgarian or English.

8. Price and payment

The first 14 days are free, with no card needed.

  • After that, you pay the price for one year in advance, in euro plus VAT.
  • You pay by card, through myPOS or Stripe. Payment does not renew automatically: we remind you 30 and 7 days before your paid year ends.
  • If you are VAT-registered in another EU country, give us your VAT number, and we will invoice you without VAT (reverse charge).
  • Aspar Software EOOD issues the invoices.
  • We give 30 days’ notice of any price change by email. It does not affect a year you have already paid for, and you can leave before it applies.
  • Exporting your data and leaving are free.

9. If you do not pay

Your shop keeps working for 7 days after the due date, while we send reminders. After that, the storefront shows “temporarily closed”. Your admin stays open, so that you can fulfil paid orders and export your data.

  • If you pay, everything is restored.
  • If you do not, we delete the shop 180 days after closing it. We warn you 30 days, 10 days and 1 day before, and give you the last day to ask for an export, 7 days before.

10. Other suspension

We may suspend all or part of your shop, but no more than necessary, for security, for a serious breach of these Terms, or on an authority’s order. Except in an emergency, we tell you first and give our reasons.

11. Leaving

You may end the contract at any time, by email. It ends with the paid period, or earlier if you ask. We may end it with 60 days’ notice, or with 14 days’ notice if you seriously breach these Terms and do not put it right.

  • Exports. At any stage you can ask for a free export of your catalogue, customers, orders and pictures: the data as JSON files and the pictures as their original files, without passwords or keys. Each export stays downloadable for 30 days, or until you make a newer one.
  • Moving to another provider, or to your own systems. Tell us when you give notice. Your shop keeps running for up to 30 more days while you move, and we help.
  • When the contract ends. We tell you the date we will delete your shop at least 30 days ahead; until then the shop stays closed. We make an export if you ask for one by the last day we give you, 7 days before the deletion; we remind you 30 and 10 days before it. Then we delete your shop and all its data, and confirm the deletion to you. Backups expire within 30 days at Google, and within 7 months at Backblaze, where they are encrypted. If you want the deletion sooner, ask us in writing, and tell us then whether you want an export.
  • Where your data is. In Google Cloud, in the EU (Frankfurt, Germany). The shop’s photos and digital files are in Cloudflare R2, in the EU. The encrypted backups are at Backblaze, in the EU (Amsterdam, Netherlands). Traffic passes through Cloudflare’s network. Every provider that receives data is listed in the DPA.

12. Your data

Your shop’s data is yours. You allow us to host, store, copy and transmit it only in order to provide the service.

  • For your shoppers’ data, we are your processor under the DPA.
  • Our Privacy Policy covers your own data.
  • We keep the business description you gave the AI assistant, and the names and prices of the products it proposed, as a record of demand. We keep them without your name and contact details, and delete them if you ask.

13. Availability and support

We aim to keep the service running continuously, but we promise no availability level and give no service credits. We announce planned maintenance where we can. Support: [email protected], on working days, in Bulgarian or English. Support never asks for your password or your code. For help in your admin, approve our request or allow access on “Support access”.

14. Liability

We are not liable for lost profits or indirect damage. Our total liability in any 12 months is limited to the fees you paid in the 12 months before the event, and is at least EUR 100. These limits do not apply to intent or gross negligence (Art. 94(1) of the Obligations and Contracts Act), or to harm to life or health. You are liable to us for claims by third parties that arise from your shop’s content or products, or from your breach of the law.

15. Changes

We email you about any change at least 30 days before it applies. You can reject a change by email before then. If you do, it does not apply to you, and either of us may end the contract: you at once, with a refund of your prepaid fees; we with 60 days’ notice. Changes required by law, or urgent for security, may apply sooner.

16. Law and language

Bulgarian law applies. Disputes go to the competent court in Sofia, after an attempt to settle them. If the Bulgarian and English texts differ, the Bulgarian text prevails.
